By accessing or using the PostMimic.ai website and services (the "Service"), operated by PostMimic ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and revising the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance.

2. Description of Service

PostMimic is an AI-powered LinkedIn content generation platform that helps users create LinkedIn posts matching their personal writing style. The Service includes:

• Tone selection and content optimization tools
• Hook analysis and scoring
• Post history and analytics
• Template library

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement.

4. Subscription Plans and Billing

The Service offers Free, Pro, and Enterprise subscription tiers. Details of each plan, including pricing and features, are available on our Pricing page.

• Free Plan: Limited features at no cost, subject to usage limits
• Paid Plans: Billed monthly or annually via Stripe. Prices are in USD unless otherwise stated
• Free Trial: Pro plan includes a 14-day free trial. You will not be charged until the trial period ends and you elect to continue
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing cycle. No partial refunds are issued for unused portions of a billing period
• Refund Policy: We offer a 30-day money-back guarantee on all paid plans. Contact support within 30 days of your first payment for a full refund

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, defamatory, obscene, or fraudulent
• Impersonate another person or misrepresent your identity
• Distribute spam, malware, or engage in phishing
• Violate LinkedIn's Terms of Service or Community Guidelines
• Attempt to reverse-engineer, decompile, or extract the AI models
• Circumvent usage limits, access controls, or security features
• Use automated scripts or bots to access the Service without authorization
• Resell or redistribute access to the Service without written consent

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

6. Intellectual Property

6.1 Our Property

The Service, including its design, code, AI models, branding, and documentation, is owned by PostMimic and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.

6.2 Your Content

You retain ownership of the content you create using the Service. By using the Service, you grant us a limited, non-exclusive license to process your input content solely for the purpose of generating output and improving the Service. We do not claim ownership of your generated posts.

6.3 AI-Generated Content

Content generated by the Service is provided as-is. You are solely responsible for reviewing, editing, and publishing any AI-generated content. We do not guarantee that generated content is original, accurate, or free from errors. You assume full responsibility for any content you publish on LinkedIn or other platforms.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee specific results, including engagement metrics, follower growth, or revenue outcomes from using the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTMIMIC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless PostMimic from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections 6 through 11 survive termination. You may delete your account at any time through your account settings.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

12. Transfer of Ownership

In the event that PostMimic is acquired, merged, or its assets are sold, these Terms and all user accounts, data, and rights may be transferred to the acquiring entity. We will provide advance notice of any such transfer. The acquiring entity will be bound by these Terms with respect to your personal information and account.
